The bench of Justice Br Gavai and Augustine George Masih said that it is the responsibility of the Legislature or Executive to implement measures to deal with this problem. The bench of the Supreme Court said, “It is not within our jurisdiction.” Recently, a bench of the Supreme Court, pointing at the opinion of the judiciary being given opinion in an important case, said, “Already allegations are being faced that we are encroaching on the powers of the Legislature and Executive.” In this regard, the Solicitor General, Tushar Mehta, who appeared by the Central Government, said that the government will not take it as an adverse legal case. He said, “We will take some measures that balance the freedom of expression with Article 19 (2) of the Constitution.”
Mehta said that some content is obscene as well as ‘deformed’. However, some regulations about it are already present and some others are being considered. Advocate Vishnu Shankar Jain, who appeared on behalf of the petitioners in this case, said that this is not an adverse legal case. This petition has raised serious concern about such content on social media and OTT. Jain said that such content is shown without any investigation or restrictions.
On this, Justice Gawai said to Mehta, “You should do something.” In response to this, Mehta said that children see more such platforms. He said, “There are some things, language and content in regular programs which are not only obscene, but perverted.” He said that some content on these platforms is so distorted that even two respectable men cannot see it sitting.
