Highcourt Ordered Swiggy Zomato to Indisposed 13 Eating Places Hyperlinks Promoting Pizza Dominos Title

The Delhi High Court has passed the order against the 13 restaurants selling online pizza named ‘Domino’ on the Food Delivery Platforms Swiggy and Zomato. The court has directed Swiggy and Jomato to remove the links related to these restaurants. All the restaurants were selling food items such as domino’s pizza using domino’s pizza. Justice Anish Dayal, while passing the order, has asked Swiggi and Jomato to follow the instructions within a week and if necessary, has also instructed the restaurants to tell about this.

The 13 food outlade’s links have been asked to down, they were selling their products from names like “Dominic Pizza”, “Dominek’s Pizza”, “Dominek Pizza”, “Domics Pizza”, “Dominick Pizza”. as well as
“Domnick Pizza”, “Dominic’s Pizza”, “Dominics Pizza”, “Dominic’s Pizza”, “Dominik Pizza” and “Domnik Pizza” were also used.

The court has asked the restaurants that they will not be able to use any similar mark like Deminos. Domino’s petition was filed in court. It was said that his trademark is being violated.

Advocate Praveen Anand appeared from Domino. He argued that the restaurants were using the signs that appeared or similar to Dominos and were selling their pizzas etc. on Swiggy and Jomato. The argument said that the restaurants took the wrong advantage of the search results. Whenever a user used to typing for dominos on the app, he would get the names of those restaurant by writing ‘DOM’, ‘DOMI’, ‘Domin’ etc.

The court was told that the customers were confused several times, as they ordered the belief that the outlade was operating by Dominos, while it was not at all. The special thing is that no lawyer was presented by the restaurants in the case. Now Swigi and Jomato will have to downs down the links of all 13 restaurants.
